Someone who nullifies the fast and someone who intentionally eats in Ramaḍān

7457- أَخْبَرَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَجُلاً جَاءَ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ، فَقَالَ‏:‏ يَا رَسُولَ اللهِ، هَلَكْتُ قَالَ‏:‏ وَمَا ذَاكَ‏؟‏ قَالَ‏:‏ وَاقَعْتُ أَهْلِي فِي رَمَضَانَ قَالَ‏:‏ أَتَجِدُ رَقَبَةً قَالَ‏:‏ لاَ، قَالَ‏:‏ أَتَسْتَطِيعُ أَنْ تَصُومَ شَهْرَيْنِ مُتَتَابِعَيْنِ‏؟‏ قَالَ‏:‏ لاَ، قَالَ‏:‏ فَأَطْعِمْ سِتِّينَ مِسْكِينًا قَالَ‏:‏ لاَ أَجِدُ يَا رَسُولَ اللهِ قَالَ‏:‏ فَأَتَى النَّبِيُّ صَلَّى الله عَلَيْهِ وَسَلَّمَ بَعَرَقٍ، فِيهِ تَمْرٌ، وَالْعَرَقُ الْمِكْتَلُ، قَالَ‏:‏ اذْهَبْ فَتَصَدَّقْ بِهَذَا قَالَ‏:‏ أَعَلَى أَفْقَرَ مِنِّي، فَوَالَّذِي بَعَثَكَ بَالْحَقِّ، مَا بَيْنَ لاَبَتَيْهَا أَهْلُ بَيْتٍ أَحْوَجُ مِنِّي، فَضَحِكَ رَسُولُ اللهِ صَلَّى الله عَلَيْهِ وَسَلَّمَ، ثُمَّ قَالَ‏:‏ اذْهَبْ بِهِ إِلَى أَهْلِكَ، قَالَ الزُّهْرِيُّ‏:‏ وَإِنَّمَا كَانَ هَذَا رُخْصَةً لِلرَّجُلِ خَاصَّةً، وَلَوْ أَنَّ رَجُلاً فَعَلَ ذَلِكَ الْيَوْمَ لَمْ يَكُنْ بُدٌّ مِنَ التَّكْفِيرِ‏.‏


7457 – Maʿmar reported to us from al-Zuhrī from Ḥumayd b. ʿAbd al-Raḥmān b. ʿAwf from Abū Hurayra that a man came to the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ and said: O Messenger of God, I have been destroyed.

He said: And what is that?

He said: I had intercourse with my wife in Ramaḍān.

He said: Do you find a slave (i.e. to emancipate)?

He said: No.

He said: Are you able to fast for two consecutive months?

He said: No.

He said: So feed sixty poor people.

He said: I do not find (the means) O Messenger of God.

He said: So the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ brought an ʿaraq in which were dates.  And the ʿaraq is the miktal (a basket made of palm-leaves in which dates are carried).

He said: Go and give charity with this.

He said: To someone who is more impoverished than me?  For by the one who sent you with the truth, there is no people of a house between its two stony tracts (i.e. Medina) who are more in need of it than us.

So the Messenger of God صَلَّى الله عَلَيْهِ وَسَلَّمَ laughed, then he said: Go with it to your family (or: wife).

al-Zuhrī said: That was only a permission for the man specifically.  Were a man to do that today, there would be no way out from rendering the atonement (al-takfīr, usually means declaring someone to be an unbeliever, but in this case appears to refer to the kaffāra, atonement, the person would have to render).


7458- عَنْ مَعْمَرٍ، عَنْ عَطَاءٍ الْخُرَاسَانِيِّ، قَالَ‏:‏ سَمِعْتُ ابْنَ الْمُسَيَّبِ يَقُولُ‏:‏ جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى الله عَلَيْهِ وَسَلَّمَ، فَقَالَ‏:‏ يَا رَسُولَ اللهِ هَلَكَ الأَخِرُ، فَقَالَ رَسُولُ اللهِ صَلَّى الله عَلَيْهِ وَسَلَّمَ‏:‏ وَمَا ذَاكَ‏؟‏ قَالَ‏:‏ أَصَبْتُ أَهْلِي فِي رَمَضَانَ، فَقَالَ لَهُ النَّبِيُّ صَلَّى الله عَلَيْهِ وَسَلَّمَ‏:‏ أَتَسْتَطِيعُ أَنْ تُعْتِقَ رَقَبَةً قَالَ‏:‏ لاَ، قَالَ‏:‏ فَأَهْدِ بَدَنَةً قَالَ‏:‏ وَلاَ أَجِدُ قَالَ‏:‏ فَأَتَى النَّبِيُّ صَلَّى الله عَلَيْهِ وَسَلَّمَ بِمِكْتَلٍ فِيهِ خَمْسَةَ عَشَرَ صَاعًا، فَقَالَ‏:‏ تَصَدَّقْ بِهَذَا فَشَكَا إِلَيْهِ الْحَاجَةَ، فَقَالَ‏:‏ عَلَيْكَ، وَعَلَى أَهْلِكَ، أَوْ قَالَ‏:‏ عِشْرُونَ صَاعًا‏.‏


7458 – Maʿmar from ʿAṭā al-Khurāsānī.  He said: I heard Ibn al-Musayyab saying: A man came to the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ and said: O Messenger of God, the last one has been destroyed.

So the Messenger of God صَلَّى الله عَلَيْهِ وَسَلَّمَ said: And what is that?

He said: I had intercourse with my wife in Ramaḍān.

The Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said to him: Are you able to emancipate a slave?

He said: No.

He said: Give a badana (a sacrificial camel).

He said: I do not find (the means).

He said: So the Prophet brought a miktal in which were fifteen ṣāʿ (of dates).  He said: Give charity with this.

So he complained to him of need.  So he said: Upon you and upon your family.

Or he said: twenty ṣāʿ.


7459- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ أَخْبَرَنِي عَطَاءٌ الْخُرَاسَانِيُّ، قَالَ‏:‏ سَمِعْتُ ابْنَ الْمُسَيَّبِ يَقُولُ‏:‏ جَاءَ أَعْرَابِيٌّ إِلَى النَّبِيِّ صَلَّى الله عَلَيْهِ وَسَلَّمَ يَضْرِبُ صَدْرَهُ، وَيَنْتِفُ شَعْرَهُ، وَيَقُولُ‏:‏ هَلَكَ الأَبْعَدُ، فَقَالَ لَهُ النَّبِيُّ صَلَّى الله عَلَيْهِ وَسَلَّمَ‏:‏ مَا شَأْنُكَ‏؟‏ قَالَ‏:‏ أَصَبْتُ فِي شَهْرِ رَمَضَانَ قَالَ‏:‏ هَلْ تَسْتَطِيعُ أَنْ تُعْتِقَ رَقَبَةً‏؟‏ قَالَ‏:‏ لاَ، قَالَ‏:‏ فَأَهْدِ قَالَ‏:‏ تُرِيدُ الْجُزُورَ‏؟‏ قَالَ‏:‏ مَا هُوَ إِلاَّ هِيَ قَالَ‏:‏ وَلاَ أَجِدُهُ قَالَ‏:‏ فَاجْلِسْ قَالَ‏:‏ فَجَلَسَ فَجَاءَ رَجُلٌ بِمِكْتَلٍ فِيهِ عِشْرُونَ صَاعًا مِنْ تَمْرٍ، أَوْ خَمْسَةَ عَشَرَ صَاعًا، فَقَالَ لِلأَعْرَابِيِّ‏:‏ تَصَدَّقْ بِهَا، فَشَكَا إِلَيْهِ الْحَاجَةَ، فَقَالَ‏:‏ عَلَيْكَ، وَعَلَى أَهْلِكَ‏.‏


7459 – Ibn Jurayj said: ʿAṭā al-Khurāsānī reported to me.  He said: I heard al-Musayyab saying: A Bedouin came to the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ striking his chest and plucking his hair saying: The furthest away has been destroyed.

So the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said to him: What is your condition?

He said: I had intercourse in the month of Ramaḍān.

He said: Are you able to emancipate a slave?

He said: No.

He said: So gift.

He said: Do you have in mind the sacrificial she-camel (al-juzūr)?

He said: It is not but it.

He said: And I do not find it.

He said: Sit.

He said: So he sat and a man came with a miktal in which was twenty ṣāʿ of dates or fifteen ṣāʿ.  He said to the Bedouin: Give charity with this.

So he complained to him of need.

So he said: Upon you and upon your family.


7460- عَنِ الثَّوْرِيِّ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، عَنِ ابْنِ الْمُسَيَّبِ، قَالَ‏:‏ جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى الله عَلَيْهِ وَسَلَّمَ، فَقَالَ‏:‏ إِنِّي وَاقَعْتُ امْرَأَتِي فِي رَمَضَانَ، ثُمَّ ذَكَرَ نَحْوَ حَدِيثِ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ‏.‏


7460 – al-Thawrī from Ḥabīb b. Abī Thābit from Ibn al-Musayyab.  He said: A man came to the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ and said to him: I had intercourse with my wife in Ramaḍān.

Then he mentioned similar to the ḥadīth of Maʿmar from al-Zuhrī from Ḥumayd b. ʿAbd al-Raḥmān.


7461- عَنْ أَبِي مَعْشَرٍ الْمَدَنِيِّ، عَنْ مُحَمَّدِ بْنِ كَعْبٍ‏:‏ أَنَّ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ أَمَرَهُ أَنْ يَصُومَ يَوْمًا مَكَانَهُ حِينَ أَمَرَهُ بِالْكَفَّارَةِ‏.‏


7461 – Abū Mashʿar al-Madanī from Muḥammad b. Kaʿb that the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ commanded him to fast a day in its place when he commanded the atonement to him.


7462- عَنِ ابْنِ جُرَيْجٍ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، أَنَّ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ قَالَ لَهُ‏:‏ تَصَدَّقْ، وَصُمْ يَوْمًا مَكَانَهُ‏.‏


7462 – Ibn Jurayj from Nāfiʿ b. Jubayr that the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said to him: Give charity and fast a day in its place.


7463- عَنْ مَعْمَرٍ، عَنِ الْحَسَنِ، وَقَتَادَةُ، أَنَّ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ قَالَ‏:‏ رَقَبَةٌ ثُمَّ بَدَنَةٌ ثُمَّ ذَكَرَ نَحْوَ حَدِيثِ الزُّهْرِيِّ‏.‏


7463 – Maʿmar from al-Ḥasan and Qatāda that the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said: A slave, then a badana, then he mentioned the ḥadīth of al-Zuhrī.


7464- عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، قَالَ‏:‏ الَّذِي يُصِيبُ أَهْلَهُ فِي رَمَضَانَ يَأْكُلُ، وَيَشْرَبُ إِنْ شَاءَ‏.‏


7464 – Ibn Jurayj from ʿAṭā.  He said: The one who has intercourse with his wife in Ramaḍān eats and drinks if he wants.


7465- عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ قَالَ‏:‏ إِنْ أَصَابَ امْرَأَتَهُ فِي رَمَضَانَ، ثُمَّ أَكَلَ، وَشَرِبَ، فَكَفَّارَةٌ وَاحِدَةٌ، كَكَفَّارَةِ الْغَشَيَانِ‏.‏


7465 – Maʿmar from Qatāda from al-Ḥasan.  He said: If one had intercourse with his wife in Ramaḍān, then he ate and drank, the atonement (al-kaffāra) is single, as the atonement of swooning (i.e. orgasm). 


7466- عَنْ مَعْمَرٍ، عَنْ أَيُّوبَ، عَنْ رَجُلٍ، عَنِ ابْنِ الْمُسَيَّبِ، فِي الَّذِي يَقَعُ عَلَى أَهْلِهِ فِي رَمَضَانَ‏؟‏ قَالَ‏:‏ قَالَ لَهُ النَّبِيُّ صَلَّى الله عَلَيْهِ وَسَلَّمَ‏:‏ أَعْتِقْ رَقَبَةً قَالَ‏:‏ لاَ أَجِدُ قَالَ‏:‏ فَتَصَدَّقْ بِشَيْءٍ قَالَ‏:‏ لاَ أَعْلَمُهُ إِلاَّ قَالَ‏:‏ فَاقْضِ يَوْمًا مَكَانَهُ‏.‏


7466 – Maʿmar from Ayyūb from a man from Ibn al-Musayyab regarding the one who has intercourse with his wife in Ramaḍān.  He said: The Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said to him: Emancipate a slave.

He said: I do not find (the means).

He said: So give charity by something.

He said: I do not know it but that he said: So do qaḍā of a day in its place.


7467- عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، قَالَ‏:‏ إِذَا الْتَقَى الْخِتَانَانِ، فَقَدْ بَطَلَ الصَّوْمُ‏.‏


7467 – Ibn Jurayj from ʿAṭā.  He said: When the two circumcised parts have met, then the fast has been nullified.


7468- عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ فِي الَّذِي يَأْكُلُ فِي رَمَضَانَ عَامِدًا قَالَ‏:‏ مِثْلُ الْمُوَاقِعِ‏.‏


7468 – Maʿmar from al-Zuhrī regarding the one who intentionally eats in Ramaḍān.  He said: The like of the one who had intercourse (? al-muwāqiʿ).


7469- عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ، قَالَ‏:‏ سَأَلْتُ ابْنَ الْمُسَيَّبِ فِي رَجُلٌ أَكَلَ فِي رَمَضَانَ عَامِدًا قَالَ‏:‏ عَلَيْهِ صِيَامُ شَهْرٍ قَالَ‏:‏ قُلْتُ‏:‏ يَوْمَيْنِ قَالَ‏:‏ صِيَامُ شَهْرٍ قَالَ‏:‏ فَعَدَدْتُ أَيَّامًا، فَقَالَ‏:‏ صِيَامُ شَهْرٍ‏.‏


7469 – Maʿmar from Qatāda.  He said: I asked Ibn al-Musayyab regarding a man who ate intentionally in Ramaḍān.  He said: The fasting of a month is upon him.

He said: I said: Two days?

He said: The fasting of a month.

He said: So I counted (a number of) days.

So he said: The fasting of a month.


7470- عَنْ مَعْمَرٍ، عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ، قَالَ‏:‏ يَقْضِي يَوْمًا وَيَسْتَغْفِرُ اللَّهُ‏.‏


7470 – Maʿmar from Ayyūb from Ibn Sīrīn.  He said: He does qaḍā of a day and seeks forgiveness of God.


7471- عَنِ ابْنِ عُيَيْنَةَ، عَنْ شَيْخٍ مِنْ بَجِيلَةَ قَالَ‏:‏ سَأَلْتُ الشَّعْبِيَّ عَنْ رَجُلٍ أَفْطَرَ يَوْمًا فِي رَمَضَانَ‏؟‏ قَالَ‏:‏ مَا يَقُولُ فِيهِ الْمَغَالِيقُ قَالَ‏:‏ ثُمَّ قَالَ الشَّعْبِيُّ‏:‏ يَصُومُ يَوْمًا مَكَانَهُ، وَيَسْتَغْفِرُ اللَّهِ‏.‏ وَقَالَهُ أَبُو حَنِيفَةَ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ‏.‏


7471 – Ibn ʿUyayna from an elder from Bajīla.  He said: I asked al-Shaʿbī about a man who broke his fast a day in Ramaḍān.

He said: What does the maghālīq (?) say regarding it?  

He said: Then al-Shaʿbī said: He fasts a day in its place and he seeks forgiveness of God.

And Abū Ḥanīfa said it from Ḥammād from Ibrāhīm.


7472- عَنْ عُثْمَانَ بْنِ مَطَرٍ، عَنْ يَعْلَى بْنِ حَكِيمٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، وَعَنْ أَبِي مَعْشَرٍ، عَنْ إِبْرَاهِيمَ، قَالاَ‏:‏ مَا نَعْلَمُ إِلاَّ أَنْ يَقْضِيَ يَوْمًا‏.‏


7472 - ʿUthmān b. Maṭar from Yaʿlā b. Ḥakīm from Saʿīd b. Jubayr and from Abū Mashʿar from Ibrāhīm.  They said: We do not know but that he does qaḍā of a day.


7473- عَنِ الثَّوْرِيِّ، عَمَّنْ، سَمِعَ إِبْرَاهِيمَ يَقُولُ مِثْلَ ذَلِكَ، وَقَالَ رَبِيعَةُ بْنُ أَبِي عَبْدِ الرَّحْمَنِ‏:‏ يَصُومُ اثْنَيْ عَشَرَ يَوْمًا‏.‏


7473 – al-Thawrī from someone who heard Ibrāhīm saying the like of that.  And Rabīʿa b. Abī ʿAbd al-Raḥmān said: He fasts for twelve days.
