When one has not found water

864- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ قُلْتُ لِعَطَاءٍ‏:‏ شَأْنُ الْمَجْدُورِ، هَلْ لَهُ رُخْصَةٌ فِي أَنْ يَتَوَضَّأَ‏؟‏ وَتَلَوْتُ عَلَيْهِ‏:‏ ‏{‏وَإِنْ كُنْتُمْ مَرْضَى، أَوْ عَلَى سَفَرٍ‏}‏، وَهُوَ سَاكِتٌ كَذَلِكَ حَتَّى جِئْتُ، ‏{‏فَلَمْ تَجِدُوا مَاءً‏}‏، قَالَ‏:‏ ذَلِكَ إِذَا لَمْ يَجِدُوا مَاءً، فَإِنْ وَجَدُوا مَاءً فَلْيَتَطَهَّرُوا قَالَ‏:‏ وَإِنِ احْتَلَمَ الْمَجْدُورُ وَجَبَ عَلَيْهِ الْغُسْلُ، وَاللهِ لَقَدِ احْتَلَمْتُ مَرَّةً، عَطَاءٌ الْقَائِلُ، وَأَنَا مَجْدُورٌ فَاغْتَسَلْتُ، هِيَ لَهُمْ كُلِّهِمْ إِذَا لَمْ يَجِدُوا الْمَاءَ، يَعْنِي الآيَةَ‏.‏


864 – Ibn Jurayj said: I said to ʿAṭā: The state of the person with smallpox, does he have a dispensation in regards to him doing wuḍū?  And I recited to him “and if you are sick or on a journey”, and he was silent until I came to “and you have not found water” (4:43, 5:6).  

He said: That is when they have not found water, so if they find water then they are to purify themselves.  

He said: And if the person with smallpox had a wet dream, the ghusl is obligatory upon him.  By God, I had a wet dream once - ʿAṭā is the one speaking – while I had smallpox, so I did ghusl.  It is for all of them when they have not found water – meaning the verse.


865- عَنِ الثَّوْرِيِّ، عَنْ عَمْرِو بْنِ مُرَّةَ، عَنْ يُوسُفَ بْنِ مَاهَكَ قَالَ‏:‏ نَزَلَ بِي رَجُلٌ فَأَصَابَتْهُ جَنَابَةٌ وَبِهِ جِرَاحَةٌ فَسَأَلْتُ عُبَيْدَ بْنَ عُمَيْرٍ، فَقَالَ‏:‏ لِيَغْسِلْ مَا حَوْلَهُ وَلاَ يَقْرَبْ جِرَاحَتَهُ الْمَاءَ‏.‏


865 – al-Thawrī from ʿAmr b. Murra from Yūsuf b. Māhak.  He said: A man lodged with us and janāba afflicted him while he had a wound.  So I asked ʿUbayd b. ʿUmayr and he said: He is to wash what is around it and not to draw the water near his wound.


866- عَنِ ابْنِ سَمْعَانَ، عَنْ عَبْدِ اللهِ بْنِ عَبْدِ الرَّحْمَنِ الأَنْصَارِيِّ، عَنْ رَجُلٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَجُلاً أَصَابَتْهُ جَنَابَةٌ وَبِهِ جِرَاحٌ فَاحْتَلَمَ فَاسْتَفْتَى، فَأَمَرُوهُ أَنْ يَغْتَسِلَ فَاغْتَسَلَ فَمَاتَ، فَذَكَرَ ذَلِكَ لِلنَّبِيِّ صَلَّى الله عَلَيْهِ وَسَلَّمَ، فَقَالَ‏:‏ مَا لَكُمْ قَتَلْتُمُوهُ قَتَلَكُمُ اللَّهُ‏.‏


866 – Ibn Samʿān from ʿAbdullāh b. ʿAbd al-Raḥmān al-Anṣārī from a man from Ibn ʿAbbās that janāba afflicted a man while he had wounds and he had a wet dream.  So he asked for a ruling and they commanded him to do ghusl.  So he did ghusl and died.   

That was mentioned to the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ so he said: What is with you?  You killed him, may God kill you!


867- عَنِ الأَوْزَاعِيِّ، عَنْ رَجُلٍ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَجُلاً كَانَ بِهِ جِرَاحٌ فَأَصَابَتْهُ جَنَابَةٌ فَأَمَرُوهُ فَاغْتَسَلَ فَمَاتَ، فَبَلَغَ ذَلِكَ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ، فَقَالَ‏:‏ قَتَلْتُمُوهُ قَتَلَكُمُ اللَّهُ، أَلَمْ يَكُنْ شِفَاءُ الْعِيِّ السُّؤَالَ‏؟‏ قَالَ عَطَاءٌ‏:‏ فَبَلَغَنِي أَنَّ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ قَالَ‏:‏ اغْتَسِلْ، وَاتْرُكْ مَوْضِعَ الْجِرَاحِ‏.‏


867 – al-Awzāʿī from a man from ʿAṭā b. Abī Rabāḥ from Ibn ʿAbbās that there was a man who had a wound, and janāba afflicted him.  So they commanded him to do ghusl and he died.  So that reached the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ and he said: You killed him, may God kill you!  Is not the cure of the helpless to ask?

ʿAṭā said: So it has reached me that the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said: Do ghusl, and leave off the place of the wounds.


868- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ أَخْبَرَنِي ابْنُ يَحْيَى، أَنَّهُ سَمِعَ طَاوُوسًا يَقُولُ‏:‏ لِلْمَرِيضِ الشَّدِيدِ الْمَرَضِ رُخْصَةٌ فِي أَنْ لاَ يَتَوَضَّأَ وَيَمْسَحَ بِالتُّرَابِ، وَقَالَ‏:‏ ‏{‏فَلَمْ تَجِدُوا مَاءً فَتَيَمَّمُوا صَعِيدًا طَيِّبًا‏}‏، قَالَ طَاوُوسٌ‏:‏ هِيَ لِلْجُنُبِ‏:‏ ‏{‏وَإِنْ كُنْتُمْ مَرْضَى‏}‏ فَذَلِكَ حَتَّى، ‏{‏أَوْ لاَمَسْتُمُ النِّسَاءَ‏}‏‏.‏ قَالَ ابْنُ جُرَيْجٍ‏:‏ فَأَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ، عَنْ طَاوُوسٍ أَنَّهُ سَمِعَهُ، وَذُكِرَ لَهُ قَوْلُهُمْ‏:‏ إِنَّ لِلْمَرِيضِ رُخْصَةً فِي أَنْ لاَ يَتَوَضَّأَ، فَمَا أَعْجَبَهُ ذَلِكَ‏.‏


868 – Ibn Jurayj, he said: Ibn Yaḥyā reported to me that he heard Ṭāwūs saying: The sick person with a severe sickness has a dispensation to not do wuḍū and to wipe with dirt.  And he said “So if you have not found water then betake to wholesome earth” 

Ṭāwūs said: It is for the junub.  “And if you are sick” so that [likely an error for: so he recited] until “or you have touched women” (5:6).

Ibn Jurayj said: ʿAmr b. Dīnār reported to me from Ṭāwūs that he heard him and he mentioned their saying to him: The sick person has a dispensation to not do wuḍū.  And that did not amaze him.


869-‏.‏‏.‏‏.‏‏.‏‏.‏‏.‏ ، عَنْ قَتَادَةَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ‏:‏ رُخْصَةٌ لِلْمَرِيضِ فِي الْوُضُوءِ التَّيَمُّمُ بِالصَّعِيدِ، وَقَالَ ابْنُ عَبَّاسٍ‏:‏ أَرَأَيْتَ إِنْ كَانَ مَجْدُورًا‏؟‏ كَأَنَّهُ كَيْفَ يَصْنَعُ بِهِ‏؟‏


869 – ……, from Qatāda from Saʿīd b. Jubayr from Ibn ʿAbbās.  He said: The dispensation for the sick person in the wuḍū is tayammum with earth.  

And Ibn ʿAbbās said: Do you see that if he has smallpox, how can he act with it?


870- عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ، قَالَ‏:‏ إِذَا كَانَ بِإِنْسَانٍ جُدَرِيٌّ، أَوْ جُرْحٌ كَبُرَ عَلَيْهِ وَخَشِيَ عَلَيْهِ، فَإِنَّهُ يَتَيَمَّمُ بِالصَّعِيدِ، قَالَ‏:‏ وَبَلَغَنِي ذَلِكَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ‏.‏


870 – Maʿmar from Qatāda.  He said: When a person has smallpox or a wound that has become grievous upon him and he fears for himself, he does tayammum with earth.  

He said: And that has reached me from Saʿīd b. Jubayr.


871- عَنِ ابْنِ جُرَيْجٍ، عَنْ حَمَّادٍ فِي الْمَجْدُورِ وَالْحَائِضِ إِذَا خَافَا عَلَى أَنْفُسِهِمَا تَيَمَّمَا يَقُولُ‏:‏ الْمَجْدُورُ إِذَا أَصَابَتْهُ جَنَابَةٌ‏.‏


871 – Ibn Jurayj from Ḥammād regarding the person with smallpox and the menstruating woman when they fear for themselves they do tayammum.  

He is saying: the person with smallpox when janāba has afflicted him.


872- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ أَخْبَرَنِي أَبَانُ، عَنِ النَّخَعِيِّ، عَنْ عَلْقَمَةَ، أَنَّ رَجُلاً كَانَ بِهِ جُدَرِيٌّ، فَأَمَرَهُ ابْنُ مَسْعُودٍ فَقُرِّبَ لَهُ تُرَابٌ فِي طَسْتٍ، أَوْ تَوْرٍ فَتَمَسَّحَ بِالتُّرَابِ‏.‏


872 – Ibn Jurayj said: Abān reported to me from al-Nakhʿī from ʿAlqama that a man had smallpox, so Ibn Masʿūd commanded him and dirt was brought near him in a basin or a small vessel, and he wiped himself with the dirt.


873- عَنِ ابْنِ الْمُبَارَكِ، عَنْ جَرِيرِ بْنِ حَازِمٍ، عَنِ النُّعْمَانِ بْنِ رَاشِدٍ، عَنْ زَيْدِ بْنِ أُنَيْسٍ قَالَ‏:‏ كَانَ بِرَجُلٍ جُدَرِيٌّ فَأَصَابَتْهُ جَنَابَةٌ فَأَمَرُوهُ، فَاغْتَسَلَ فَانْتَثَرَ لَحْمُهُ فَمَاتَ، فَذُكِرَ ذَلِكَ لِلنَّبِيِّ صَلَّى الله عَلَيْهِ وَسَلَّمَ، فَقَالَ‏:‏ قَتَلُوهُ قَتَلَهُمُ اللَّهُ، أَلَمْ يَكُنْ شِفَاءُ الْعِيِّ السُّؤَالَ‏؟‏ لَوْ تَيَمَّمَ بِالصَّعِيدِ‏.‏


873 – Ibn al-Mubārak from Jarīr b. Ḥāzim from al-Nuʿmān b. Rāshid from Zayd b. Anīs.  He said: A man had smallpox and janāba afflicted him, so they commanded him and he did ghusl and his flesh shed and he died.  

That was mentioned to the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ and he said: They killed him, may God kill them.  Is not the cure of the helpless to ask?  If only he had done tayammum with earth.


874- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ أَخْبَرَنِي مَنْ أُصَدِّقُ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ‏:‏ إِنَّ رُخْصَةً لِلْمَرِيضِ فِي التَّمَسُّحِ بِالتُّرَابِ وَهُوَ يَجِدُ الْمَاءَ‏.‏


874 – Ibn Jurayj said: Someone that I believe reported to me from Saʿīd b. Jubayr from Ibn ʿAbbās.  He said: The dispensation for the sick person is in wiping with dirt while he finds water.
