The man who janāba afflicts while he does not find water save for snow

927- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ قُلْتُ لِعَطَاءٍ‏:‏ لَوْ أَنَّ رَجُلاً احْتَلَمَ فِي أَرْضِ ثَلْجٍ فِي الشَّتَاءِ يَرَى أَنَّهُ إنِ اغْتَسَلَ مَاتَ وَلاَ يَقْدِرُ عَلَى أَنْ يُجَهِّزَ لَهُ مَا يَغْتَسِلُ بِهِ أَيَغْتَسِلُ‏؟‏ قَالَ‏:‏ نَعَمْ، وَإِنْ مَاتَ، قَالَ اللَّهُ‏:‏ ‏{‏وَإِنْ كُنْتُمْ جُنُبًا فَاطَّهَّرُوا‏}‏ وَمَا جَعَلَ اللَّهُ لَهُ مِنْ عُذْرٍ‏.‏


927 – Ibn Jurayj said: I said to ʿAṭā: Were a man to have a wet dream in a snowy land in the wintertime, he regards that if he were to do ghusl he would die, and he is not able to be supplied with what one does ghusl with, does he do ghusl?

He said: Yes, even if he died.  God said “And if you are junub then purify yourselves” (5:6) and God has not made an excuse for him.


928- عَنِ الثَّوْرِيِّ، عَنْ جَابِرٍ قَالَ‏:‏ سَأَلْتُ الشَّعْبِيَّ، وَالْحَكَمَ، عَنِ الثَّلْجِ، فَقَالاَ‏:‏ يُتَوَضَّأُ بِهِ‏.‏ قَالَ سُفْيَانُ‏:‏ وَالتَّيَمُّمُ أَحَبُّ إِلَيَّ مِنَ الثَّلْجِ إِذَا لَمْ يُسَخِّنْهُ‏.‏


928 – al-Thawrī from Jābir.  He said: I asked al-Shaʿbī and al-Ḥakam about snow.  So they said: One does wuḍū with it.

Sufyān said: And tayammum is preferable to me from snow when one has not warmed it.


929- عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ، قَالَ‏:‏ إِذَا لَمْ يَجِدِ الْجُنُبُ إِلاَّ‏.‏‏.‏‏.‏‏.‏‏.‏ فَلْيُذِبْهُ، فَإِنْ لَمْ يَجِدْ نَارًا وَلَمْ يَسْتَطِعِ الْوُضُوءَ مِنْهُ فَالتَّيَمُّمُ بِالصَّعِيدِ‏.‏


929 – Maʿmar from Qatāda.  He said: When the junub has not found aught save for …. so he is to melt it, and if he did not find a fire and was not able (to do) the wuḍū from it, then (he does) the tayammum with earth.
