Hides of the dead animal when it has been tanned

184- أَخْبَرَنَا أَبُو سَعِيدٍ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ زِيَادِ بْنِ بِشْرٍ الأَعْرَابِيُّ قَالَ‏:‏ حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ قَالَ‏:‏ قَرَأْنَا عَلَى عَبْدِ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ‏:‏ مَرَّ رَسُولُ اللهِ صَلَّى الله عَلَيْهِ وَسَلَّمَ عَلَى شَاةٍ لِمَوْلاَةٍ لِمَيْمُونَةَ فَقَالَ‏:‏ أَفَلاَ اسْتَمْتَعْتُمْ بِإِهَابِهَا‏؟‏ قَالُوا‏:‏ فكَيْفَ، وَهِيَ مَيْتَةٌ يَا رَسُولَ اللهِ‏؟‏ قَالَ‏:‏ إِنَّمَا حُرِّمَ لَحْمُهَا‏.‏


184 – Abū Saʿīd Aḥmad b. Muḥammad b. Ziyād b. Bishr al-Aʿrābī reported to us.  He said: Isḥāq b. Ibrāhīm al-Dabarī narrated to us.  He said: I recited upon ʿAbd al-Razzāq from Maʿmar from al-Zuhrī from ʿUbaydullāh b. ʿAbdullāh b. ʿUtba from Ibn ʿAbbās.  He said: The Messenger of God passed upon a ewe from a clientess of Maymūna.  So he said: Will you not make use of its skin?  They said: How, while it is a dead animal, O Messenger of God?  He said: Only its flesh has been forbidden.


185- عَنْ مَعْمَرٍ، وَكَانَ الزُّهْرِيُّ، يُنْكِرُ الدِّبَاغَ وَيَقُولُ‏:‏ يُسْتَمْتَعُ بِهِ عَلَى كُلِّ حَالٍ‏.‏


185 – From Maʿmar: And al-Zuhrī used to deny tanning and he would say: It is made use of in every state.


186- عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، أَنَّ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ قَالَ‏:‏ إِذَا دُبِغَ جِلْدُ الْمَيْتَةِ فَحَسْبُهُ فَلْيَنْتَفِعْ بِهِ‏.‏


186 – Ibn Jurayj from ʿAṭā that the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said: When the hide of the dead animal (al-mayta) has been tanned, then it is enough and one is to make use of it.


187- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ سَمِعْتُ عَطَاءً يَقُولُ‏:‏ سَمِعْتُ ابْنَ عَبَّاسٍ يَقُولُ‏:‏ كَانَتْ شَاةٌ دَاجِنَةٌ لإِحْدَى نِسَاءِ النَّبِيِّ صَلَّى الله عَلَيْهِ وَسَلَّمَ، فَمَاتَتْ، فَقَالَ النَّبِيُّ صَلَّى الله عَلَيْهِ وَسَلَّمَ‏:‏ أَفَلاَ اسْتَمْتَعْتُمْ بِإِهَابِهَا‏؟‏


187 – Ibn Jurayj said: I heard ʿAṭā saying: I heard Ibn ʿAbbās saying: One of the women of the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ had a domesticated ewe and it died.  So the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said: Will you not make use of its skin?


188- أَخْبَرَنَا ابْنُ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ‏:‏ أَخْبَرَتْنِي مَيْمُونَةُ، أَنَّ شَاةً مَاتَتْ، فَقَالَ النَّبِيُّ صَلَّى الله عَلَيْهِ وَسَلَّمَ‏:‏ أَلاَ دَبَغْتُمْ إِهَابَهَا‏.‏


188 – Ibn Jurayj reported to us from ʿAṭā from Ibn ʿAbbās.  He said: Maymūna reported to me that a ewe died.  So the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ said: Have you not tanned its skin?


189- أَخْبَرَنَا ابْنُ جُرَيْجٍ، قَالَ‏:‏ حَدَّثَنِي غَيْرُ عَطَاءٍ، أَنَّ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ اسْتَوْهَبَ وَضُوءًا، فَقِيلَ لَهُ‏:‏ مَا نَجِدُ لَكَ إِلاَّ فِي مَسْكِ مَيْتَةٍ قَالَ‏:‏ أَدَبَغْتُمُوهُ‏؟‏ قَالُوا‏:‏ نَعَمْ قَالَ‏:‏ هَلُمَّ فَإِنَّ ذَلِكَ طَهُورٌ‏.‏


189 – Ibn Jurayj reported to us.  He said: Someone other than ʿAṭā narrated to me that the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ asked for some wuḍū-water.  So it was said to him: We do not find any for you save for in the hide of a dead animal.  He said: Did you tan it?  They said: Yes.  He said: Bring it, for that is a purification.


190- عَنِ الثَّوْرِيِّ، عَنْ زَيْدِ بْنِ أَسْلَمَ، قَالَ‏:‏ حَدَّثَنِي عَبْدُ الرَّحْمَنِ بْنُ وَعْلَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ‏:‏ قُلْتُ لَهُ‏:‏ إِنَّا نَغْزُو أَهْلَ الْمَشْرِقِ فَنُؤْتَى بِالأُهُبِ بِالأَسْقِيَةِ قَالَ‏:‏ مَا أَدْرِي مَا أَقُولُ لَكَ إِلاَّ أَنِّي سَمِعْتُ رَسُولَ اللهِ صَلَّى الله عَلَيْهِ وَسَلَّمَ يَقُولُ‏:‏ أَيُّمَا إِهَابٍ دُبِغَ فَقَدْ طَهُرَ‏.‏


190 – al-Thawrī from Zayd b. Aslam.  He said: ʿAbd al-Raḥmān b. Waʿla narrated to me from Ibn ʿAbbās.  He said: I said to him: We raid the people of the East and we are brought the water-skins.  He said: I don’t know what to say to say to you except that I heard the Messenger of God صَلَّى الله عَلَيْهِ وَسَلَّمَ saying: Any skin that has been tanned then it has been purified.


191- عَنْ مَالِكِ بْنِ أَنَسٍ، قَالَ‏:‏ حَدَّثَنِي يَزِيدُ بْنُ عَبْدِ اللهِ بْنِ قُسَيْطٍ، عَنِ ابْنِ ثَوْبَانَ، عَنْ أُمِّهِ، عَنْ عَائِشَةَ، أَنَّ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ أَمَرَ أَنْ يُسْتَمْتَعَ بِجُلُودِ الْمَيْتَةِ إِذَا دُبِغَتْ‏.‏


191 – Mālik b. Anas said: Yazīd b. ʿAbdullāh b. Qusayṭ narrated to me from Ibn Thawbān from his mother from ʿĀ’isha that the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ commanded for the hides of the dead animal to be made use of when they have been tanned.


192- عَنِ الثَّوْرِيِّ، عَنِ ابْنِ أَبِي لَيْلَى، عَنْ ثَعْلَبَةَ، عَنْ أَبِي وَائِلٍ، عَنْ عُمَرَ، أَنَّهُ سُئِلَ عَنْ مَيْتَةٍ فَقَالَ‏:‏ طُهُورُهَا دِبَاغُهَا‏.‏


192 – al-Thawrī from Ibn Abī Laylā from Thaʿlaba from Abī Wā’il from ʿUmar that he was asked about a dead animal.  So he said: Its purification is its tanning.


193- عَنِ الثَّوْرِيِّ، عَنْ يُونُسَ بْنِ عُبَيْدٍ، عَنِ الْحَسَنِ، أَنَّ النَّبِيَّ صَلَّى الله عَلَيْهِ وَسَلَّمَ اسْتَسْقَى فَأُتِيَ بِسِقَاءٍ قِيلَ‏:‏ إِنَّهُ مَيْتٌ، وَذَكَرُوا الدِّبَاغَ قَالَ‏:‏ فَشَرِبَ النَّبِيُّ صَلَّى الله عَلَيْهِ وَسَلَّمَ مِنْهُ‏.‏


193 – al-Thawrī from Yūnus b. ʿUbayd from al-Ḥasan that the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ asked for some water so he was brought a water-skin.  It was said: It is a dead animal.  And they mentioned tanning.  He said: So the Prophet صَلَّى الله عَلَيْهِ وَسَلَّمَ drank from it.


194- عَنِ الثَّوْرِيِّ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ، قَالَ‏:‏ سَأَلْتُهُ، عَنِ الرَّجُلِ تَكُونُ لَهُ الإِبِلُ وَالْبَقَرُ وَالْغَنَمُ فَتَمُوتُ فَتُدْبَغُ جُلُودُهَا قَالَ‏:‏ يَبِيعُهَا، أَوْ يَلْبَسُهَا‏.‏


194 – al-Thawrī from Ḥammād from Ibrāhīm.  He said: I asked him about the man who has camels, cattle and sheep, so one dies and he tans its hide.  He said: He sells it or he wears it.


195- عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ، مِثْلَ قَوْلِ إِبْرَاهِيمَ‏.‏


195 – Maʿmar from Qatāda the like of the saying of Ibrāhīm.


196- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ قُلْتُ لِعَطَاءٍ‏:‏ أَيَبِيعُ الرَّجُلُ جُلُودَ الضَّأْنِ الْمَيْتَةِ لَمْ تُدْبَغْ‏؟‏ قَالَ‏:‏ مَا أُحِبُّ أَنْ تَأْكُلَ ثَمَنَهَا، وَإِنْ تُدْبَغُ‏.‏


196 – Ibn Jurayj said: I said to ʿAṭā: Does the man sell hides of dead sheep that have not been tanned?  He said: I do not like for you to consume its price, even if it is tanned.


197- عَنْ مَعْمَرٍ، عَمَّنْ سَمِعَ الْحَسَنَ، يَقُولُ فِي جُلُودِ الْمَيْتَةِ‏:‏ طُهُورُهَا دِبَاغُهَا قَالَ‏:‏ وَكَانَ الْحَسَنُ يَقُولُ‏:‏ يُنْتَفَعُ بِهَا وَلاَ تُبَاعُ‏.‏


197 – Maʿmar from someone who heard al-Ḥasan saying regarding the hides of the dead animal: Its purification is its tanning.  He said: And al-Ḥasan used to say: One makes use of it but he does not sell it.


198- عَنِ الثَّوْرِيِّ، عَنْ عِيسَى بْنِ أَبِي عَزَّةَ، عَنْ عَامِرٍ الشَّعْبِيِّ، قَالَ‏:‏ ذَكَاةُ الْجُلُودِ دِبَاغُهَا فَالْبَسْ‏.‏


198 – al-Thawrī from ʿĪsā b. Abī ʿIzza from ʿĀmir al-Shaʿbī.  He said: The dhakā (Islamic slaughtering) of hides is their tanning, so wear it.


199- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ أَخْبَرَنَا نَافِعٌ، مَوْلَى ابْنِ عُمَرَ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدِ بْنِ أَبِي بَكْرٍ، أَنَّ مُحَمَّدَ بْنَ الأَشْعَثِ، كَلَّمَ عَائِشَةَ فِي أَنْ يَتَّخِذَ لَهَا لَحَافًا مِنَ الْفِرَاءِ، فَقَالَتْ‏:‏ إِنَّهُ مَيْتَةٌ وَلَسْتُ بِلاَبِسَةٍ شَيْئًا مِنَ الْمَيْتَةِ قَالَ‏:‏ فَنَحْنُ نَصْنَعُ لَكَ لَحَافًا نَدْبَغُ وَكَرِهَتْ أَنْ تَلْبَسَ مِنَ الْمَيْتَةِ‏.‏


199 – Ibn Jurayj said: Nāfiʿ the client of Ibn ʿUmar reported to us from al-Qāsim b. Muḥammad b. Abī Bakr that Muḥammad b. al-Ashʿath spoke to ʿĀ’isha regarding him getting a quilt for her made from fur.  So she said: It is only a dead animal, and I do not wear anything from the dead animal.  He said: So we will make a quilt for you which we will tan.  And she disliked to wear anything from the dead animal.


200- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ سَمِعْتُ عَطَاءً يَسْأَلُ عَنْ أَوْلاَدِ الضَّأْنِ، تُسْتَلُّ مِنْ أَجْوَافِ أُمَّهَاتِهَا فَتَخْرُجُ مَيِّتَةً فَتُجْعَلُ مُسُوكُهَا فِرَاءً قَالَ‏:‏ أَتُدْبَغُ‏؟‏ قَالَ‏:‏ نَعَمْ قَالَ‏:‏ فَحَسْبُهُ، الْبَسُوهُ‏.‏


200 – Ibn Jurayj said: I heard ʿAṭā being asked about the babies of sheep, being drawn from the bellies of their mothers, so they come out dead:  So their hides are made into furs.  He said: Is it tanned?  He said: Yes.  He said: It is enough, wear it.


201- عَنِ ابْنِ جُرَيْجٍ، قَالَ عَطَاءٌ‏:‏ مَا نَسْتَمْتِعُ مِنَ الْمَيْتَةِ إِلاَّ بِجُلُودِهَا، إِذَا دُبِغَتْ فَإِنَّ دِبَاغَهَا طُهُورُهُ وَذَكَاتُهُ‏.‏


201 – Ibn Jurayj said that ʿAṭā said: We do not benefit from the dead animal save by its hides, when it has been tanned, for its tanning is its purification and its dhakā.


202- عَنْ عَبْدِ اللهِ بْنِ كَثِيرٍ، عَنْ شُعْبَةَ، عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى، عَنْ عَبْدِ اللهِ بْنِ عُكَيْمٍ قَالَ‏:‏ قُرِئَ عَلَيْنَا كِتَابُ رَسُولِ اللهِ صَلَّى الله عَلَيْهِ وَسَلَّمَ فِي أَرْضِ جُهَيْنَةَ وَأَنَا غُلاَمٌ شَابٌّ أَلاَّ تَسْتَمْتِعُوا مِنَ الْمَيْتَةِ بِشَيْءٍ بِإِهَابٍ وَلاَ عَصَبٍ‏.‏


202 – ʿAbdullāh b. Kathīr from Shuʿba from al-Hakam b. ʿUtayba from ʿAbd al-Raḥmān b. Abī Laylā from ʿAbdullāh b. ʿUkaym.  He said: A letter of the Messenger of God صَلَّى الله عَلَيْهِ وَسَلَّمَ was read to us in the land of Juhayna when I was a young boy: Do not make use of anything from a dead animal, neither by a skin nor a sinew.


203- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ قُلْتُ لِعَطَاءٍ‏:‏ أَرَأَيْتَ لَوِ اضْطُرِرْتُ فِي سَفَرٍ إِلَى مَاءٍ فِي ظَرْفِ مَيْتَةٍ لَمْ يُدْبَغْ، أَوٍ إِلَى مَاءٍ فِيهِ فَأْرَةٌ مَيِّتَةٌ لَيْسَ مَعِي مَاءٌ غَيْرُهُ فَهُوَ أَحَبُّ إِلَيْكَ أَنْ تُطَهِّرَ بِهِ أَمِ التُّرَابُ‏؟‏ قَالَ‏:‏ بَلْ هُوَ أَحَبُّ إِلَيَّ مِنَ التُّرَابِ قُلْتُ‏:‏ فَنَدَعُهُ فِي الْقَرَارِ‏؟‏ قَالَ‏:‏ نَعَمْ، قُلْتُ‏:‏ فَتَوَضَّأْتُ بِهِ فِي الْقَرَارِ وَلاَ أَدْرِي، ثُمَّ صَلَّيْتُ الْمَكْتُوبَةَ، ثُمَّ عَلِمْتُ قَبْلَ أَنْ تَفُوتَنِي تِلْكَ الصَّلاَةُ قَالَ‏:‏ فَعُدْ فَتَوَضَّأْ ثُمَّ عُدْ لِصَلاَتِكَ قَالَ‏:‏ قُلْتُ‏:‏ فَعَلِمْتُ بَعْدُ مَا فَاتَنِي قَالَ‏:‏ فَلاَ تُعِدْ‏.‏


203 – Ibn Jurayj said: I said to ʿAṭā: Do you regard that if you were compelled in a journey to make use of water in a container made from a dead animal which had not been tanned or to water in which there is a dead mouse, there not being water other than it with me, is it preferable to you to purify oneself with it or with dirt (i.e. tayammum)?  He said: Rather, using the water is preferable to me than the dirt.  I said: So do we leave it off in the state of being settled?  He said: Yes.  I said: So I did wuḍū with it in the state of being settled while I didn’t know.  Then I prayed the ordained prayer, then I came to know prior to that prayer passing me by.  He said: So repeat and do wuḍū, then repeat for your prayer.  He said: So if I came to know after it had passed me by?  He said: So do not repeat.
