Someone who touches someone else’s penis

448- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ قُلْتُ لِعَطَاءٍ‏:‏ أَرَأَيْتَ لَوْ مَسَسْتُ ذَكَرَ غُلاَمٍ صَغِيرٍ‏؟‏ قَالَ‏:‏ تَوَضَّأْ‏.‏


448 – Ibn Jurayj said: I said to ʿAṭā: How do you regard if I were to touch the penis of a little boy?  

He said: Do wuḍū.


449- عَنِ ابْنِ جُرَيْجٍ، قَالَ‏:‏ قُلْتُ لِعَطَاءٍ‏:‏ مَسَسْتُ قُنْبَ حِمَارٍ، أَوْ ثَيْلَ جَمَلٍ قَالَ‏:‏ أَمَّا قُنْبُ الْحِمَارِ فَكُنْتَ مُتَوَضِّئًا، وَأَمَّا مِنْ ثَيْلِ الْجَمَلِ فَلاَ قُلْتُ‏:‏ فَمَاذَا يُفَرِّقُ بَيْنَهُمَا‏؟‏ قُلْتُ‏:‏ مِنْ أَجْلِ الْحِمَارِ وَهُوَ أَنْجَسُ قَالَ‏:‏ وَأَقُولُ‏:‏ أَنَا أَنْظُرُ كُلَّ شَيْءٍ نَجِسٍ كَهَيْئَةِ الْحِمَارِ لاَ يُؤْكَلُ لَحْمُهُ مَسَّ مِنْهُ ذَلِكَ فَعَلَيْهِ الْوُضُوءُ، وَكُلُّ شَيْءٍ يُؤْكَلُ لَحْمُهُ كَهَيْئَةِ الْبَعِيرِ مَسَّ ذَلِكَ مِنْهُ فَلاَ وُضُوءَ مِنْهُ‏.‏


449 – Ibn Jurayj said: I said to ʿAṭā: I touched the sheath of the penis of a donkey, or the sheath of the penis of a camel.  

He said: As to the sheath of the penis of the donkey, then you are doing wuḍū, and as to the sheath of the penis of the camel, then no.  

I said: So what is the difference between them?  I said: Because the donkey is more impure.  

He said: And I say: I look at every impure thing like the form of the donkey, whose meat is not eaten, (if one) touches that from it then the wuḍū is upon him.  And everything whose meat is eaten like the form of the camel, (if one) touches that from it then there is no wuḍū from it.
