باب في الرجل يُجْنِبُ وليس معَهُ إلا ماءٌ قليل


The man who becomes junub while there is only a little water with him


وبه قال: حدثنا محمد، قال: حدثنا عباد بن يعقوب، عن إبراهيم بن أبي يحيى، عن أبي أيوب، عن يزيد بن أبي حبيب، عن بكر بن سوادة، أن رجلين أصابتهما جنابة فتيمما ثم صليا، فأدركا الماء في وقت فاغتسلا، وأعاد أحدهما ولم يعد الآخر، فذكر للنبيصلى الله عليه وآله وسلم-. فقال صلى الله عليه وآله: ((أما الذي أعادها فله أجرها مرتين، وأما الذي لم يعد، فقد أجزته صلاته)).


`Abbad b. Ya`qub narrated to us from Ibrahim b. Abi Yahya from Abu Ayyub from Yazid b. Abi Habib from Bakr b. Sawada that janaba had afflicted two men so they did tayammum then they prayed.  So they reached the water in a time (of the salat) and did ghusl, and one of them repeated (the salat) while the other did not repeat.  So it was mentioned to the Prophet صلى الله عليه وآله وسلم, so he صلى الله عليه وآله وسلم said: As to the one who repeated it, then he has its reward twice.  And as to the one who did not repeat, then his salat has sufficed him.


وبه قال محمد: سمعت قاسم بن إبراهيم، أو أثبت لي عنه يقول: إن سأل سائل عن رجل معه بلغة من الماء وهو مسافر، فخاف إن تطهّرَ بها أن يهلك عطشا؟ قيل له: لا يحل له أن يتوضأ بالماء الذي معه إذا كان أمره في ذلك كذلك؛ لأن الله تعالى حرم عليه إتلاف نفسه وإهلاكها. فقال: ?وَلاَ تَقْتُلُوا أَنفُسَكُمْ إِنَّ اللَّهَ كَانَ بِكُمْ رَحِيمًا، وَمَنْ يَفْعَلْ ذَلِكَ عُدْوَانًا وَظُلْمًا فَسَوْفَ نُصْلِيهِ نَارًا وَكَانَ ذَلِكَ عَلَى اللَّهِ يَسِيرًا?[النساء:29،30]. وعليه أن يتيمم صعيداً طيباً كما أمر الله تعالى، فيمسح به وجهه ويديه، ويمسك الماء على نفسه، وكذلك من خاف على نفسه سلطاناً أو لصوصاً أو سبعاً أو برداً، إن تطهر بالماء، فعليه أن يتيمم بالصعيد الطيب، ومحرم عليه في جميع ذلك أن يعرض نفسه للتلف والعطب.


I heard Qasim b. Ibrahim saying – or it was established for me from him: If a questioner asks about a man a sufficient (amount) of water with him and he is a traveler, so he fears that he is purifies himself with it that he will be perish of thirst?  It is said to him: It is not lawful for him to do wudu with the water which is with him when his affair in that is thus, for Allah تعالى has forbidden to him the damaging of his self and his destruction.  So He said “Do not kill yourselves, Allah is merciful to you.  But whoever does that in transgression and wrongfully, him We shall certainly roast at a Fire; and that for Allah is an easy matter.” (4:29-30) And it is upon him to do tayammum with clean earth as Allah تعالى commanded, so he wipes his face and his arms with it, and he keeps the water for himself.  And likewise someone who feared for himself due a sultan or thieves or predatory animals or coldness if he purified himself with the water, then it is upon him to do tayammum with clean earth, and it is forbidden for him in all of that to expose himself to perishing and dying.


وبه قال أبو جعفر: ذُكر عن أبي جعفر محمد بن علي، وعن غيره فيمن اغتسل في برد من الجنابة فأصيب، أنه شهيد.


Abu Ja`far said: He mentioned from Abu Ja`far Muhammad b. `Ali and other than him, regarding someone who did ghusl from janaba in coldness and so was afflicted, that he is a martyr.


وبه قال محمد: سمعت قاسم بن إبراهيم، أو أثبت لي عنه يقول: أيُّمَا مسافر وجد مع غيره ماء، فلم يعطه إلا بثمن غال، قال: وكان المسافر لثمنه واجداً، فعليه أن يشتريه؛ لأنه واجد له بما وجد من ثمنه، لقوله سبحانه: ?فَلَمْ تَجِدُوا مَاءً فَتَيَمَّمُوا?[المائدة:6]، فهو واجدٌ له في اللغة، بوجوده لثمنه. إلا أن يكون في دفعه ثمن الماء إجحاف بنفسه، أو يعرضها للعطب والتلف، فيكون له حينئذ أن لا يشتري الماء وأن يتيمم صعيداً طيباً.


I heard Qasim b. Ibrahim saying – or it was established for me from him:  Any traveler that finds water with someone else, and he does not give it to him save at an expensive price – he said – and the traveler finds (the means) for his price, then it is upon him to purchase it, for he has the means for it by what he has found of its price, due to His saying “So if you did not find water then betake (do tayammum)” (5:6), so he has the means (waajid) for it linguistically by his having the means (bi-wujoodihi) for its price, unless in his spending of the price of the water there is oppression to himself, or he presents it for dying and perishing, so then it would (allowed) for him to not purchase the water and to do tayammum with clean earth.


وبه قال: حدثنا محمد، قال: حدثنا إسماعيل بن موسى، عن شريك، عن عطاء، عن زاذان عن علي -عليه السلام-: (في الرجل معه الماء اليسير، قال: يبقيه لشقيه ويتيمم).


Isma`il b. Musa narrated to us from Shurayk from `Ata from Zadhan from `Ali عليه السلام regarding the man who has little water with him.  He said: He keeps it for his adversity and he does tayammum.
