Jami` al-Bazanti

From Ahmad b. Muhammad b. Abi Nasr al-Bazanti's book al-Jami`, he having been a companion of Imam `Ali b. Musa ar-Rida عليه السلام
 

قال في هذا الكتاب، وسألته عن الرجل يمسح جبهته من التراب وهو في صلاته قبل أن يسلم؟ قال لا بأس . 

 

He said in this book:  And I asked him about the man who wipes his forehead of dirt while he is in his salat prior to doing taslim?  He said: There is no harm.

 

قال وسألته عن رجل يلتفت في صلاته هل يقطع ذلك صلاته قال إذا كانت الفريضة والتفت إلى خلفه، فقد قطع صلاته، فيعيد ما صلى ولا يعتد به، وإن كانت نافلة فلا يقطع ذلك صلاته ولكن لا يعود . 

 

He said: And I asked him about a man who turns around in his salat, does that break his salat?  He said: If it is the farida and he turns around to (face) behind himself, then his salat has been broken and he is to repeat what he prayed and is not to reckon by it (i.e. not to count what he already did in the salat).  And if it was a nafila then it does not break his salat, however he is not to go back.

 

قال وسألته عن الرجل اشترى ثوبا من السوق لبيسا لا يدري لمن كان؟ يصلح  له الصلاة فيه؟ قال إن كان اشتراه من مسلم فليصل فيه، وإن اشتراه من نصراني فلا يلبسه ولا يصلي فيه حتى يغسله . 

 

He said: And I asked him about the man who purchases an article of clothing from the market (but) he does not know to whom it belonged.  Is salat appropriate for him in it?  He said: If he has purchased it from a Muslim, then he is to pray in it, and if he has purchased it from a Christian, then he is not to wear it and not to pray in it until he washes it.

 

وسألته عن الرجل يسجد ثم لا يرفع يديه من الأرض هل  يسجد الثانية هل يصلح  له ذلك؟ قال ذلك نقص في الصلاة .

 

And I asked him about the man who does sajda then he does not raise his hands from the ground, does he do the second sajda, is that appropriate for him?  He said: That is a deficiency in the salat.

 

 وسألته عن رجل أراد أن يقرأ مائة آية أو أكثر في نافلة، فيتخوف أن يضعف وكسل، هل يصلح أن يقرأها وهو جالس؟ قال ليصلي ركعتين بما أحب، ثم لينصرف فليقرأ ما بقي عليه مما أراد قرائته، فإن ذلك يجزيه مكان قرائته وهو قائم، فإن بدا له أن يتكلم بعد التسليم من الركعتين، فليقرأ فلا بأس . 

 

And I asked him about a man who wants to recite a hundred or more ayat in the nafila, but he fears that he will be weakened and  drowsy, is it appropriate for him to recite while he is sitting?  He said: He is to pray two raka`at of what he likes, then he departs (from the salat, i.e. finishes it) and he is to recite what remains upon him of what he wanted to recite, for that suffices for him in place of his recitation while he is standing.  So if it seems proper to him to speak after the taslim from the two rak`at, then he is to recite and there is no harm.

 

قال: وسألته عن الزوال يوم الجمعة ما حده؟ قال إذا قامت الشمس فصل ركعتين، فإذا زالت فصل الفريضة ساعة تزول، فإذا زالت قبل أن تصلي الركعتين فلا تصلهما وابدأ بالفريضة واقض الركعتين بعد الفريضة. 

 

He said: And I asked him about the zawal (declension of the sun) on the day of jum`a, what is its definition?  He said: When the sun is standing then pray two rak`at, so when it declines then pray the farida as soon as it declines.  So if it declined prior to you praying the two rak`at, then do not pray them and begin with the farida, and do qada of the two rak`at after the farida.

 

وسألته عن ركعتي الزوال يوم الجمعة قبل الأذان أو بعده؟ قال قبل الأذان . 

 

And I asked him about the two rak`at of zawal on the day of jum`a, is it before the adhan or after it?  He said: Before the adhan.

 

قال وسألته عن صلاة الكسوف ما حده؟ قال متى أحب ويقرأ ما أحب، غير أنه يقرأ ويركع ويقرأ ويركع أربع ركعات، ثم يسجد في الخامسة، ثم يقول فيفعل مثل ذلك . 

 

He said: And I asked him about the salat of the eclipse, what is its definition? He said:  When one likes and recite what one likes, other than that one recites and does ruku`, and recites and does ruku`, (for) four rak`at then one does sajda in the fifth.  Then one says and does like that.

 

قال وسألته عن القراءة في صلاة الكسوف، فهل يقرأ في كل ركعة بفاتحة الكتاب؟ قال إذا ختمت سورة وبدأت بأخرى فاقرأ بفاتحة الكتاب، وإن قرأت سورة في ركعتين أو ثلاثة، فلا تقرأ بفاتحة الكتاب حتى تختم السورة، ولا تقول سمع الله لمن حمده في شئ من ركوعك إلا الركعة التي تسجد فيها . 

 

He said: And I asked him about the qira’at in the salat of the eclipse, so does one recite the Fatiha of the Book in every rak`at?  He said: When you finish a sura and another is begun then recite the Fatiha of the Book.  And if you recite a sura in two rak`at or three, then do not recite the Fatiha of the Book until you finish the sura.  And do not say “sami`allah liman hamidah” in anything of your ruku` except the rak`at in which you do sajda. 

 

قال وسألته عن صلاة الكسوف هل على من تركها قضاء؟ قال إذا فاتتك فليس عليك قضاء . 

 

He said: And I asked him about the salat of the eclipse, is there qada upon the one who neglects it?  He said: If it passes by you then there is no qada upon you.

 

قال وسألته عن رجل يكون له الغنم يقطع من إلياتها وهي أحياء، أيصلح أن ينتفع بما قطع؟ قال نعم يذيبها ويسرج بها، ولا يأكلها ولا يبيعها .

 

He said: And I asked him about a man who has a sheep.  He cuts off from its fat tail while it is alive.  Is it appropriate for him to make use of what he cut off?  He said: Yes, he dissolves it and lights (a lamp) with it, and he does not eat it and does not sell it.

 

قال وسألته عن الرجل يكتب المصحف بالأجر؟ قال لا بأس . 

 

He said: And I asked him about the man who writes the mashaf (of the Quran) for a fee?  He said: There is no harm.

 

قال وسألته عن رجل كانت عنده وديعة لرجل فاحتاج إليها، هل يصلح له أن يأخذ منها، وهو مجمع على أن يردها بغير إذن صاحبها؟ قال إذا كان عنده وفاء، فلا بأس بأن يأخذ ويرد .

 

He said: And I asked him about a man who has a trust (that belong) to (another) man and he has need of it.  Is it appropriate for him to take from it, and he is agreed upon that he will return (or, pay) it back, without the permission of its owner?  He said: If he is faithful (to his promise) then there is not harm that he take (from it) and return (it).

 

قال محمد بن إدريس لا يلتفت إلى هذا الحديث، ولا إلى الحديث الذي قبله بحديث لأنهما وردا في نوادر الأخبار، والأدلة بخلافهما، وهو الاجماع منعقد على تحريم الميتة والتصرف فيها بكل حال، إلا أكلها للمضطر غير الباغي والعادي، وكذلك الاجماع منعقد على تحريم التصرف في الوديعة بغير إذن ملاكها، فلا يرجع عما يقتضيه العلم إلى ما يقتضيه الظن، وبعد هذا فأخبار الآحاد لا يجوز العمل بها على كل حال في الشرعيات على ما بيناه. 

 

Muhammad b. Idris said: Neither this hadith nor the hadith that is before it is turned to, for they have been referred to in the rare reports.  And the evidence is opposite to them, and it is the ijma` that is convened upon the forbiddance of the mayta (dead animal) and free use (tasarruf) in it in every state, except for eating it for the one who is compelled without being desirous (of it) or (it being) customary.  And likewise the ijma` that is convened upon the forbiddance of free use of the trust without the permission of its owner.   Thus, that which knowledge necessitates is not overturned by that which supposition requires. And beyond that, then it is not permissible in any state to act upon the solitary narrations (akhbar al-ahad) in the laws as we have made clear.

 

وسألته عن رجل، كان له مسجد في بعض بيوته أو داره، هل يصلح أن يجعله كنيفا؟ قال لا بأس . 

 

And I asked him about a man who had a masjid in some of his houses or his home, is it appropriate for him to make it a washroom?  He said: There is no harm.

 

قال وسألته عن الرجل يلبس الخاتم في اليمنى؟  قال إن شئت في اليمنى  وإن شئت في الشمال .

 

He said: And I asked him about the man, (does) he wear the ring on his right (hand)?  He said: If he wills, on his right, and if he wills, on his left.

 

قال وسألته عن السرج واللجام فيه الفضة، أيركب به؟ قال إن كان مموها لا يقدر على نزعه منه، فلا بأس، وإلا فلا يركب به .

 

He said: And I asked him about the saddle and rein in which there is silver, does one ride with it?  He said: If it is silvered (and) one it not able to extract it from it, then there is no harm.  Otherwise, than one does not ride with it (or, it is not ridden with).

 

قال وسألته عن الرجل هل له أن يأخذ من لحيته؟ قال أما من عارضيه فلا بأس، وأما من مقدمها فلا . 

 

He said: And I asked about the man, is it (permissible) for him to take from his beard?  He said: As to his two cheeks (or, sides of the face) then there is no harm.  However from its front, then no.
