باب من كره الحلف بالله


Who disliked swearing by Allah


88 - القاسم بن محمد، عن علي، عن أبي بصير، قال، حدثني أبو جعفر عليه السلام أن أباه كان تحته امرأة من الخوارج - أظنها كانت من بني حنيفة -. فقال له مولى له: يابن رسول الله إن عندك امرأة تتبرأ من جدك. قال [ فعقر ] فعلمت أنه طالقها، فادعت عليه صداقها، فجاءت به إلى أمير المدينة تستعديه عليه، فقالت: لي عليه صداقي أربعمائة دينار. فقال الوالي: ألك بينة؟ فقالت: لا، ولكن خذ يمينه. فقال والي المدينة: يا علي إما أن تحلف، وإما أن تعطيها فقال [ لي ]: يا بني قم فأعطها أربعمائة دينار، فقلت: يا أبه جعلت فداك ألست محقا؟ فقال: بلى يا بني ولكني أجللت الله أن أحلف به يمين صبر


88 – al-Qasim b. Muhammad from `Ali from Abu Basir.  He said: Abu Ja`far عليه السلام narrated to me that there used to a woman from the Khawarij under his father – I think she was from the Banu Hanifa.  So a client of his said to him: O son of the Messenger of Allah, you have a woman with you who renounces your grandfather.  He said: So she became barren (?) and knew that he had divorced her, so she claimed her sadaq (mahr) against him.  She brought him to the commander of Medina appealing for assistance against him, and she said: I have upon him my sadaq of four hundred dinar.  The governor said: Do you have evidence?  She said: No, however take his oath.  So the governor of Medina said: O `Ali, either I make you swear, or you give to her.  So he said to me: O my son, get up and give her four hundred dinar.  I said: O father, may I be made your ransom, are you not in the right?  So he said: Yea, O my son, however I have venerated Allah that I have sworn by Him an enforced oath.


89 – عن زرارة، عن أبي جعفر أو عن أبي عبد الله عليهما السلام قال: قال: لا أرى أن يحلف الرجل إلا بالله، فأما قول الرجل: لا بل شانئك فإنه من قول الجاهلية، ولو حلف الناس بهذا وأشباهه لترك الحلف بالله. وأما قول الرجل: (يا هناه) أو (ياهباه) فإنما ذلك طلب الاسم ولا أرى به بأسا. وأما قوله: (لعمرو الله) وقوله: (لا هلاه إذا)، فإنما هو بالله


89 – From Zurara from Abu Ja`far or from Abu `Abdillah عليهما السلام.  He said: I do not regard that the man swears but by Allah.  So as to the saying of the man “la bulla shani’uka”, then it is from the saying of Jahiliyya.  And were a man to swear by this or what is similar to it, swearing by Allah would have abandoned.  And as to the saying of the man “ya hanah” or “ya habah” then that is only seeking the name and I do not regard there to be harm with it.  And as to his saying “la-`amrillah” (by the everlasting existence of Allah) and his saying “la halaha idha”, then is it only by Allah.

Translator’s note: “la bulla shani’uka” is understood to mean your hater has no father, and was used in the time of Jahiliyya in taking an oath.  Similarly “ya hanah” was also used to take an oath, however it simply means “O so-and-so”, or as we would say today colloquially “Hey you” when a person is addressing someone and they have forgotten their name and so there is no objection to it.


90 – ابن أبي عمير، عن منصور بن يونس، عن الثمالي، عن علي بن الحسين عليهما السلام، قال: قال رسول الله صلى الله عليه وآله: لا تحلفوا إلا بالله، ومن حلف بالله فليصدق، ومن حلف له بالله فليرض، ومن حلف له بالله فلم يرض فليس من الله.


90 – Ibn Abi `Umayr from Mansur b. Yunus from ath-Thumali from `Ali b. al-Husayn عليهما السلام.  He said: The Messenger of Allah صلى الله عليه وآله said: Do not swear but by Allah, and one who swears by Allah then he is to speak the truth.  And one for whom swearing has been done by Allah then he is to accept.  And one for whom swearing has been done by Allah and he did not accept, then he (or: it) is not from Allah.


91 – وعنه، عن الحلبي، عن أبي عبد الله عليه السلام، قال: سألته عن استحلاف أهل الذمة؟ فقال: لا تحلفوهم إلا بالله


91 – And from him from al-Halabi from Abu `Abdillah عليه السلام.  He said: I asked him about seeking an oath from the people of dhimma.  So he said: Do not take their oath but by Allah.


92 – عثمان بن عيسى، عن أبي أيوب، عن أبي عبد الله عليه السلام، قال: لا تحلفوا بالله صادقين ولا كاذبين، فإن الله قد نهى عن ذلك، فقال: (لا تجعلوا الله عرضة لايمانكم). 


92 – `Uthman b. `Isa from Abu Ayyub from Abu `Abdillah عليه السلام.  He said: Do not swear by Allah truly or lying, for Allah has prohibited that.  So he said “Do not make Allah a hindrance through your oaths”.


93 - وقال أبو أيوب: من حلف بالله فليصدق، ومن لم يصدق فليس من الله، ومن حلف له بالله فليرض، ومن لم يرض فليس من الله


93 – And Abu Ayyub said: Whoever swears by Allah then he is to speak the truth, and whoever does not speak the truth then he (or: it) is not from Allah.  And for whoever swearing is done by Allah then he is to accept, and whoever did not accept then he (or: it) is not from Allah.


94 - عن محمد بن مسلم، قال: قلت لابي جعفر عليه السلام في قول الله: (والليل إذا يغشى) (والنجم إذا هوى) وما أشبه ذلك؟  قال: إن لله أن يقسم من خلقه بما شاء، وليس لخلقه أن يقسموا إلا به


94 – From Muhammad b. Muslim, he said: I said to Abu Ja`far عليه السلام regarding the saying of Allah “By the night when it covers” “By the star when it falls” and what is similar to that.  He said: It is for Allah to swear from His creation by whatever He wills, and it not for His creation to swear but by Him.


95 - عن أبي بصير، عن أبي عبد الله عليه السلام أنه قال: لو حلف الرجل أن لا يحك أنفه بالحائط، لابتلاه الله حتى يحك أنفه بالحائط. وقال: لو حلف الرجل لا ينطح الحائط برأسه، لوكل الله به شيطانا حتى ينطح رأسه بالحائط


95 – From Abu Basir from Abu `Abdillah عليه السلام that he said: Were the man to swear that would not scrape his nose by the wall, Allah would afflict him until he would scrape his nose by the wall.  And he said: Were the man to swear that he would not butt his head by the wall, Allah would assign a Shaytan to him until he butt his head by the wall.


96 - ابن فضال، عن يونس بن يعقوب، قال: كان أبو عبد الله عليه السلام كثيرا ما يقول: والله


96 – Ibn Faddal from Yunus b. Ya`qub said: Abu `Abdillah عليه السلام used to say “By Allah” a lot.


97 - علي قال: قرأت في كتاب أبي جعفر عليه السلام إلى داود بن القاسم، إني جئت وحياتك


97 – `Ali said: I read in the letter of Abu Ja`far عليه السلام (i.e. Muhammad al-Jawad) to Dawud b. al-Qasim: I have come, by your life.


98 - علي [ بن مهزيار ]، قال: كتب رجل إلى أبي جعفر عليه السلام يحكي له شيئا. فكتب إليه: والله ما كان ذلك، وإنى لاكره أن أقول: والله على حال من الاحوال، ولكنه غمني أن يقال ما لم يكن.


98 – `Ali b. Mahziyar said: A man wrote to Abu Ja`far عليه السلام telling him something.  So he wrote to him: By Allah, it was not that.  And indeed I dislike saying “By Allah” upon (any) state from the states, however it grieves me for what was not (correct) to be said.
