Chapter 19

If the divorcee wants to do a visitation while she is in `idda


[ 28421 ] 1 ـ محمّد بن يعقوب ، عن علي بن إبراهيم ، عن أبيه ، عن عثمّان بن عيسى ، عن سماعة بن مهران ، قال : سألته عن المطلّقة ، أين تعتد ؟ قال : في بيتها ، لا تخرج ، وإن أرادت زيارة خرجت بعد نصف الليل ، ولا تخرج نهارا ، وليس لها أن تحج حتى تنقضي عدتها ، وسألته عن المتوفى عنها زوجها أكذلك هي ؟ قال : نعم ، وتحجُّ إن شاءت .

ورواه الصدوق بإسناده عن سماعة ، عن أبي عبدالله ( عليه السلام ) نحوه . إلا أنه ترك حكم المتوفى عنها ، وقال : خرجت بعد نصف الليل ، ورجعت قبل نصف الليل .

ورواه الشيخ بإسناده عن محمّد بن يعقوب .


1 – Muhammad b. Ya`qub from `Ali b. Ibrahim from his father from `Uthman b. `Isa from Sama`a b. Mihran.  He said: I asked him about the divorcee, where does she observe `idda?  So he said: In her house, she does not go out.  And if she wants (to do) a visitation, she goes out after the half of the night, and she does not go out by day.  And it is not for her to perform hajj until her `idda has ended.

And I asked him about the one whose husband has deceased, is she thus?  He said: Yes, but she performs hajj if she wants.

And as-Saduq narrated it by his isnad from Sama`a from Abu `Abdillah عليه السلام similarly, except that he left off the ruling of the one whose husband has died, and he said: she goes out after the half of the night, and returns before the half of the night.

And the Shaykh narrated it by his isnad from Muhammad b. Ya`qub.
