Chapter 4 – The obligation of the fasting person refraining from sexual intercourse and ejaculation by foreplay and what is similar to it, and the obligation of the atonement with them should he do so, and the ruling of anal intercourse

[ 12776 ] 1 ـ محمد بن يعقوب ، عن محمد بن يحيى ، عن محمد بن الحسين ، عن صفوان ، عن عبدالرحمن بن الحجاج قال : سألت أبا عبدالله ( عليه السلام ) عن الرجل يعبث بأهله في شهر رمضان حتى يمني ؟ قال : عليه من الكفارة مثل ما على الذي يجامع . ورواه الشيخ بإسناده عن محمد بن يعقوب . وبإسناده عن الحسين بن سعيد ، عن صفوان ، إلا أنه ترك قوله : من الكفارة


1 – Muḥammad b. Yaʿqūb from Muḥammad b. Yaḥyā from Muḥammad b. al-Ḥusayn from Ṣafwān from ʿAbd ar-Rahman b. al-Hajjaj.  He said: I asked Abū ʿAbdillāh عليه السلام about the man who plays with his wife until he ejaculates in the month of Ramaḍān.  

He said: There is upon him of atonement (al-kaffāra) the like of what is upon the one who has sexual intercourse.

And the Shaykh narrated it by his isnād from Muḥammad b. Yaʿqūb.

And by his isnād from al-Ḥusayn b. Saʿīd from Ṣafwān, except that he left off his saying: of atonement.


[ 12777 ] 2 ـ وعن علي بن إبراهيم ، عن أبيه ، عن ابن أبي عمير ، عن حفص بن سوقه ، عمن ذكره ، عن أبى عبدالله ( عليه السلام ) في الرجل يلاعب أهله أو جاريته وهو في قضاء شهر رمضان فيسبقه الماء فينزل ، قال : عليه من الكفارة مثل ما على الذي جامع في شهر رمضانمحمد بن الحسن بإسناده عن محمد بن علي بن محبوب ، عن يعقوب بن يزيد ، عن ابن أبي عمير مثله وبإسناده عن الصفار ، عن يعقوب بن يزيد مثله .


2 – And from ʿAlī b. Ibrāhīm from his father from Ibn Abī ʿUmayr from Ḥafṣ b. Sūqa from the one he mentioned from Abū ʿAbdillāh عليه السلام regarding the man who plays with his wife or his slave girl while he is in the qaḍā of the month of Ramaḍān, and the water (i.e. semen) outstrips him and he ejaculates.  

He said: There is upon him of atonement the like of what is upon the one who has sexual intercourse during the month of Ramadan.

Muḥammad b. al-Ḥasan by his isnād from Muḥammad b. ʿAlī b. Maḥbūb from Yaʿqūb b. Yazīd from Ibn Abī ʿUmayr likewise. (not found in al-Tadhhīb)

And by his isnād from al-Ṣaffār from Yaʿqūb b. Yazid likewise.


[ 12778 ] 3 ـ وبإسناده عن موسى بن القاسم ، عن صفوان ، والحسن بن محبوب ، عن عبدالرحمن بن الحجاج ، عن أبي عبدالله ( عليه السلام ) قال : سألته عن رجل يعبث بامرأته حتى يمني وهو محرم من غير جماع ، أو يفعل ذلك في شهر رمضان ؟ فقال ( عليه السلام ) : عليهما جميعا الكفارة مثل ما على الذى يجامع . وبإسناده عن الحسين بن سعيد ، عن صفوان ، عن عبدالرحمن بن الحجاج مثله . ورواه الكليني كما يأتي في الحج


3 – And by his isnād from Mūsā b. al-Qāsim from Ṣafwān from al-Ḥasan b. Maḥbūb from ʿAbd al-Raḥmān b. al-Ḥajjāj from Abū ʿAbdillāh عليه السلام.  He said: I asked him about a man who is playing with his wife until he ejaculates from other than sexual intercourse while he is a muḥrim, or he does that in the month of Ramaḍān.  

He عليه السلام said: There is upon both of them of atonement the like of what is upon the one who has sexual intercourse.

And by his isnād from al-Ḥusayn b. Saʿīd from Ṣafwān from ʿAbd al-Raḥmān b. al-Ḥajjāj likewise.

And al-Kulaynī narrated it as is coming in the section of ḥajj.


 [ 12779 ] 4 ـ وبإسناده عن أحمد بن محمد ، عن محمد بن الحسين ، عن عثمان بن عيسى ، عن سماعة قال : سألته عن رجل لزق بأهله فأنزل ؟ قال : عليه اطعام ستين مسكيناً ، مد لكل مسكين


4 – And by his isnād from Aḥmad b. Muḥammad from Muḥammad b. al-Ḥusayn from ʿUthmān b. ʿĪsā from Samāʿa.  He said: I asked him about a man who clung to his family and he ejaculated.  

He said: The feeding of sixty poor people is upon him, a mudd for each poor person.


 [ 12780 ] 5 ـ وعنه عن أحمد بن محمد ، عن الحسين ، عن القاسم ، عن علي ، عن أبي بصير قال : سألت أبا عبدالله ( عليه السلام ) عن رجل وضع يده على شيء من جسد امرأته فأدفق ؟ فقال : كفارته أن يصوم شهرين متتابعين ، أو يطعم ستين مسكينا ، أو يعتق رقبه


5 – And from him from Ahmad b. Muḥammad from al-Ḥusayn from al-Qāsim from ʿAlī from Abū Baṣīr.  He said: I asked Abū ʿAbdillāh عليه السلام about a man who put his hand on something of the body of his wife, so he poured forth.  

He said: His atonement is that he fasts two consecutive months or he feeds sixty poor people or he emancipates a neck (frees a slave).


 أقول : وتقدم ما يدل على حكم الوطء في الدبر في الجنابة ، وتقدم ما يدل على حكم الجماع ، ويأتي مايدل عليه .


I say: And there has preceded what indicates upon the ruling for anal intercourse in the section on janāba (ch. 12.3 in chpts. “janāba”), and there has preceded what indicates upon the ruling of intercourse (ch. 1, ch. 2.6 from these chpts.; and ch. 4.1 in chpts. “the obligation of the fast”), and there is coming what indicates upon it (ch. 8-12 and 22, ch. 26.7, ch. 33, ch. 35.4, ch. 43.4,5, and ch. 44.2 from these chpts.; and ch. 7.1 from the chpts. “who the fast is sound from”).
