Chapter 25

The ruling of someone who still has qada from the previous month of Ramadan upon them and the next month of Ramadan reaches them


[ 13543 ] 1 ـ محمد بن يعقوب ، عن علي بن إبراهيم ، عن أبيه ، عن ابن أبي عمير ، عن حماد ، عن حريز ، عن محمد بن مسلم ، عن أبي جعفر وأبي عبدالله ( عليهما السلام ) قال : سألتهما عن رجل مرض فلم يصم حتى أدركه رمضان آخر ؟ فقالا : إن كان برء ثم توانى قبل أن يدركه الرمضان الآخر صام الذي أدركه وتصدق عن كل يوم بمد من طعام على مسكين وعليه قضاؤه ، وإن كان لم يزل مريضا حتى أدركه رمضان آخر صام الذي أدركه وتصدق عن الاول لكل يوم مد على مسكين وليس عليه قضاؤه .


1 – Muhammad b. Ya`qub from `Ali b. Ibrahim from his father from Ibn Abi `Umayr from Hammad from Hariz from Muhammad b. Muslim from Abu Ja`far and Abu `Abdillah عليهما السلام.  He said: I asked them about a sick man who did not fast until another Ramadan reached him.  So they said: If he had become healthy then he tarried until the other Ramadan reached him, he fasts the one that has reached him and gives charity from every day by a mudd of food for a poor person, and its qada is upon him.  And if he had not ceased to be ill until another Ramadan reached him, he fasts the one that has reached him and gives charity from the first a mudd for a poor person for every day, and there is no qada upon him.


[ 13544 ] 2 ـ وعنه ، عن أبيه ، وعن محمد بن إسماعيل ، عن الفضل بن شاذان جميعا ، عن ابن أبي عمير ، عن جميل ، عن زرارة ، عن أبي جعفر ( عليه السلام ) في الرجل يمرض فيدركه شهر رمضان ويخرج عنه وهو مريض ولا يصح حتى يدركه شهر رمضان آخر ، قال : يتصدق عن الاول ويصوم الثاني ، فإن كان صح فيما بينهما ولم يصم حتى أدركه شهر رمضان آخر صامهما جميعا ويتصدق عن الاول .


2 – And from him from his father and from Muhammad b. Isma`il from al-Fadl b. Shadhan all from Ibn Abi `Umayr from Jamil from Zurara from Abu Ja`far عليه السلام regarding the man who is sick and the month of Ramadan reaches him and goes out from him while he is sick, and he does become healthy until another month of Ramadan reaches him.  He said: He gives charity from the first and he fasts the second.  So if he had become healthy in what was between them, and he had not fasted until the other month of Ramadan reached him, he fasts them both and he gives charity from the first.


[ 13545 ] 3 ـ وعن محمد بن يحيى ، عن أحمد بن محمد ، عن محمد بن إسماعيل ، عن محمد بن الفضيل ، عن أبي الصباح الكناني قال : سألت أبا عبدالله ( عليه السلام ) عن رجل عليه من شهر رمضان طائفة ثم أدركه شهر رمضان قابل ؟ قال : عليه أن يصوم وأن يطعم كل يوم مسكينا ، فإن كان مريضا فيما بين ذلك حتى أدركه شهر رمضان قابل فليس عليه إلا الصيام إن صح ، وإن تتابع المرض عليه فلم يصح فعليه أن يطعم لكل يوم مسكينا .

محمد بن الحسن بإسناده عن محمد بن يعقوب وذكر الاحاديث الثلاثة .


3 – And from Muhammad b. Yahya from Ahmad b. Muhammad from Muhammad b. Isma`il from Muhammad b. al-Fudayl from Abu ‘s-Sabbah al-Kinani.  He said: I asked Abu `Abdillah عليه السلام about a man upon whom there is group from the month of Ramadan, then the next month of Ramadan reaches him.  He said: It is upon him to fast and to feed a poor person for every day.  So if he had been sick in what was between that until the next month of Ramadan reached him, naught but the fasting is upon him if he became healthy.  And if the illness followed upon him (or: it) and he had not become healthy, then it is upon him to feed a poor person for every day.

Muhammad b. al-Hasan by his isnad from Muhammad b. Ya`qub, and he mentioned the three hadiths.


[ 13546 ] 4 ـ وعنه ، عن فضالة ، عن عبدالله بن سنان ، عن أبي عبدالله ( عليه السلام ) قال : من أفطر شيئا من رمضان في عذر ثم أدرك رمضان آخر وهو مريض فليتصدق بمد لكل يوم ، فأما أنا فإني صمت وتصدقت .


4 – And from him from Fadala from `Abdullah b. Sinan from Abu `Abdillah عليه السلام.  He said: Whoever breaks his fast in something of Ramadan in an excuse and another Ramadan reaches him while he is sick, then he is to give charity by a mudd for every day.  So as to me, then I fast and I give charity.


[ 13547 ] 5 ـ وعنه ، عن عثمان بن عيسى ، عن سماعة قال : سألته عن رجل أدركه رمضان وعليه رمضان قبل ذلك لم يصمه فقال : يتصدق بدل كل يوم من الرمضان الذي كان عليه بمد من طعام ، وليصم هذا الذي أدرك ، فاذا أفطر فليصم رمضان الذي كان عليه ، فإني كنت مريضا فمر علي ثلاث رمضانات لم أصح فيهن ثم أدركت رمضانا آخر فتصدقت بدل كل يوم مما مضى بمد من طعام ، ثم عافاني الله تعالى وصمتهن .


5 – And from him from `Uthman b. `Isa from Sama`a.  He said: I asked him about someone who Ramadan reaches while there is a Ramadan prior to that upon him which he did not fast.  So he said: He gives charity by a mudd of food in place of every day of the Ramadan which was upon him, and he is to fast this one which he reached.  So when he breaks his fast (i.e. when the month is finished), then he is to fast the Ramadan which is upon him (i.e. the qada one from before).  So I used to be ill and three Ramadans passed over me in which I was not healthy, then I reached another Ramadan so I gave charity by a mudd of food in place of each day of what had passed, then Allah تعالى healed me and I fasted them.


[ 13548 ] 6 ـ وعنه ، عن القاسم بن محمد ، عن علي ، عن أبي بصير ، عن أبي عبدالله ( عليه السلام ) قال : إذا مرض الرجل من رمضان إلى رمضان ثم صح فإنما عليه لكل يوم أفطره فدية طعام وهو مد لكل مسكين ، قال : وكذلك أيضا في كفارة اليمين وكفارة الظهار مداً مداً ، وإن صح فيما بين الرمضانين فانما عليه أن يقضي الصيام ، فإن تهاون به وقد صح فعليه الصدقة والصيام جميعا لكل يوم مدا إذا فرغ من ذلك الرمضان .


6 – And from him from al-Qasim b. Muhammad from `Ali from Abu Basir from Abu `Abdillah عليه السلام.  He said: When the man is sick from Ramadan to Ramadan then becomes healthy, for every day which he broke his fast there is only a redemption of food, and it is a mudd for each indigent.  He said: And thus it also is in the atonement of an oath and the atonement of zhihar, a mudd for each.  And if he becomes healthy between the two Ramadans, then it is only upon him to do qada of the fasting.  So if he neglected it and he had become healthy, then charity and fasting are both upon him, a mudd for each day when he is finished from that Ramadan.


[ 13551 ] 9 ـ عبدالله بن جعفر في ( قرب الاسناد ) عن عبدالله بن الحسن ، عن جده علي بن جعفر ، عن أخيه موسى بن جعفر ( عليه السلام ) قال : سألته عن رجل تتابع عليه رمضانان لم يصح فيهما ثم صح بعد ذلك ، كيف يصنع ؟ قال : يصوم الاخير ويتصدق عن الاول بصدقة لكل يوم مد من طعام لكل مسكين .

ورواه علي بن جعفر في كتابه نحوه .


9 – `Abdullah b. Ja`far in Qurb al-Isnad from `Abdullah b. al-Hasan from his grandfather `Ali b. Ja`far from his brother Musa b. Ja`far عليه السلام.  He said: I asked him a man upon whom two Ramadans follow in which he was not healthy, then he became healthy after that, how does he act?  He said: He fasts the last one and gives give from the first by a charity of a mudd of food to every poor person for every day.

And `Ali b. Ja`far narrated it in his book similarly.


[ 13552 ] 10 ـ وعنه ، عن علي بن جعفر عن أخيه قال : سألته عن رجل مرض في شهر رمضان فلم يزل مريضا حتى أدركه شهر رمضان آخر فبرأ فيه كيف يصنع ؟ قال : يصوم الذي يبرأ فيه ، ويتصدق عن الاول كل يوم بمد من طعام .


10 – And from him from `Ali b. Ja`far from his brother.  He said: I asked him about a man who became sick in the month of Ramadan and he did not cease to be sick until another month of Ramadan reached him, so he became healthy in it, how does he act?  He said: He fasts the one in which he became healthy, and he gives charity by a mudd of food for every day from the first.


[ 13553 ] 11 ـ محمد بن مسعود العياشي في ( تفسيره ) عن أبي بصير قال : سألته عن رجل مرض من رمضان إلى رمضان قابل ولم يصح بينهما ولم يطق الصوم ؟ قال : يتصدق مكان كل يوم أفطر على مسكين بمد من طعام ، وإن لم يكن حنطة فمد من تمر وهو قول الله ( فدية طعام مساكين ) فإن استطاع أن يصوم الرمضان الذي استقبل وإلا فليتربص إلى رمضان قابل فيقضيه ، فإن لم يصح حتى جاء رمضان قابل فليتصدق كما تصدق مكان كل يوم أفطر مدا مدا ، فإن صح فيما بين الرمضانين فتوانى أن يقضيه حتى جاء الرمضان الآخر فإن عليه الصوم والصدقة جميعا ، يقضي الصوم ويتصدق من أجل أنه ضيع ذلك الصيام .


11 – Muhammad b. Mas`ud al-`Ayyashi in his Tafsir from Abu Basir.  He said: I asked him about a man who became sick from Ramadan to the next Ramadan, and he had not fasted between them and he cannot endure the fast.  He said: He gives charity in place of every day he broke his fast by a mudd of food upon a poor person.  And if it is not wheat then a mudd of dates, and it is the saying of Allah “a redemption by feeding a poor man” (2:184).  So unless he is able to fast the Ramadan which he anticipated (?) he is to wait to the coming Ramadan and do its qada.  So if he did not become healthy until the coming Ramadan, then he is to give charity as he gave charity in place of every day that he broke his fast a mudd (by) a mudd.  So if he became healthy in what is between the two Ramadans, and he tarried in doing its qada until the other Ramadan came, then both the fast and the charity are upon him.  He does qada of the fast and gives charity due to him having lost that fasting.
